Terms and Conditions of Use
These Terms and Conditions ("Terms") govern your access to and use of the salon management software (“Software”, “Service”, "Application") provided by BOOKURE.COM (“we”, “us”, or “our”). By accessing or using the Software, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Software.
1. Definitions
- "User": Any individual or business accessing or using the Software.
- "Salon": A registered business using the Software to manage operations.
- "Client": An end-customer of a salon using services offered by the salon.
- "Subscription Plan": The paid or free plan selected by a salon for usage.
2. Account Registration
To access the full functionality of the Software, you must create an account. You agree to provide accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
3. User Obligations
- You must not use the Software for any illegal or unauthorized purpose.
- You may not attempt to disrupt or damage the Software infrastructure or security features.
- You are responsible for ensuring that your use complies with all applicable laws and regulations.
4. Subscription & Payment Terms
Certain features of the Software require a paid subscription. You agree to pay all fees as per your selected Subscription Plan. Payments are due in advance, and failure to pay may result in suspension or termination of service.
5. Data Collection and Privacy
We collect and process salon, staff, and client data in accordance with our Privacy Policy. You retain ownership of your data, but grant us the right to store, process, and back up such data as necessary to provide the service.
6. Intellectual Property
All intellectual property rights in the Software, including but not limited to design, code, logos, and trademarks, are owned by Bookure. You may not duplicate, distribute, modify, or reverse-engineer any part of the Software.
7. Availability and Maintenance
While we strive to provide continuous access to the Software, we do not guarantee uptime. The Software may be temporarily unavailable for maintenance, upgrades, or due to force majeure events.
8. Termination of Service
We reserve the right to suspend or terminate your account without notice if you breach these Terms. Upon termination, all access to your data and features may be revoked, and any unpaid balances will become immediately due.
9. Limitation of Liability
We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of revenue or data, arising out of or in connection with the use of the Software.
10. Indemnification
You agree to indemnify and hold BOOKURE.COM, its directors, officers, and affiliates harmless from any claim or demand arising out of your use of the Software or violation of these Terms.
11. Modifications to Terms
We may revise these Terms at any time. Continued use of the Software after changes are made constitutes your acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kerala.
